Judicial Branch of the National Iranian Congress

The Judicial Branch is one of the three foundational branches of the National Iranian Congress (NIC) and serves as the guardian of law, justice, and constitutional integrity within the organization. Its primary role is to ensure that all actions taken by the legislative and executive branches comply with the NIC’s governing principles, laws, and constitutional framework.

Role and Responsibilities

The Judicial Branch is responsible for:

  • Interpreting the laws and regulations adopted by the NIC Senate
  • Adjudicating disputes arising within the NIC’s institutional structure
  • Reviewing actions of the Executive Cabinet to ensure legality and due process
  • Upholding the rule of law and protecting organizational rights and responsibilities

Through these functions, the Judiciary provides an independent mechanism for accountability, fairness, and lawful governance.

Structure and Appointment

The Judicial Branch is headed by the Attorney General of the National Iranian Congress, who serves as the chief legal authority of the organization.

  • The Attorney General is nominated and appointed by the NIC Senate for a defined term, ensuring independence from the Executive Branch.
  • Judicial appointments, procedures, and disciplinary standards are subject to Senate confirmation, reinforcing transparency and institutional balance.
  • Judges and legal officers operate independently and are bound solely by NIC laws and constitutional principles, free from political or executive influence.

Independence and Democratic Oversight

A core principle of the NIC Judiciary is judicial independence combined with democratic accountability. While the Judicial Branch functions independently in its legal judgments, its leadership is appointed through a representative and transparent process, ensuring legitimacy and public trust.

The Judiciary acts as a neutral arbiter between branches, preventing abuses of power and ensuring that no branch operates beyond its constitutional authority.

Democracy in Practice

As the National Iranian Congress works to present a credible democratic alternative for Iran’s political future, it deliberately practices the rule of law and separation of powers within its own organization. The existence of an independent Judiciary—empowered to review, interpret, and enforce the law—demonstrates that democracy within the NIC is not symbolic, but operational.

By modeling a justice system rooted in legality, due process, and institutional independence, the NIC affirms its commitment to a future Iran governed by law rather than force, accountability rather than impunity, and justice rather than arbitrary power.
